Gender Dynamics in Home Ownership in Kampala, Uganda

Cette étude explore les différentes manières dont les femmes mariées à Kampala, en Ouganda, sont incapables de devenir propriétaires pendant le mariage et au veuvage. Dans le processus, l'étude explore également les mécanismes spéciaux par lesquels les femmes mariées sont devenues propriétaires par le mariage et au veuvage. L'étude était fondée sur l'hypothèse que l'inégalité entre les sexes dans l'accession à la propriété existe et persiste en Ouganda malgré l'urbanisation, l'augmentation du flux d'informations, l'éducation et le revenu des femmes. Bien que les femmes mariées vivent dans une maison avec leur mari, elles ne sont pas réellement propriétaires de la maison. En conséquence, les femmes ont tendance à être des utilisatrices plutôt que des propriétaires. Même si l'on s'attendrait à ce qu'une loi statutaire garantisse aux femmes mariées un logement
droits de propriété pendant le mariage, ce n'est pas le cas. Alors que la politique de l'État ougandais stipule que chaque citoyen a le droit de posséder des biens, en particulier des maisons, il n'existe aucun cadre juridique garantissant aux femmes mariées des droits de propriété égaux sur le logement. Les lois actuelles sur le mariage et le divorce ne sont pas claires sur les avantages de la femme mariée dans le foyer conjugal pendant le mariage et le divorce. En cas de divorce, les prestations de la femme mariée dans le foyer conjugal sont à la discrétion du juge qui détermine le pourcentage du droit d'une femme mariée au foyer conjugal sur la preuve des preuves présentées par la femme mariée. Le projet de loi sur les relations familiales quiremédierait aux relations inégales entre les sexes dans l'accession à la propriété et garantirait probablement aux femmes mariées des prestations dans le foyer conjugal n'a jamais été adoptée. Bien qu'un certain nombre d'ONG et d'organisations de la société civile aient fait pression sur le Parlement pour qu'il adopte le projet de loi sur les relations familiales, aucun progrès n'a été réalisé. De même, alors que l'on s'attendrait à ce qu'une veuve hérite automatiquement du domicile conjugal au décès de son mari, le droit successoral ab intestat garantit à la veuve les seuls droits d'utilisation du domicile jusqu'à son décès ou son remariage. Le domicile conjugal appartient au fils aîné du malade. Bien que la Cour constitutionnelle ait récemment déclaré certaines des clausesdans une loi sur les successions ab intestat inconstitutionnelle, le Parlement n'a pas encore élaboré de nouvelle loi sur les successions.
